Will I Qualify for Parental Leave?

Adoptive parents are entitled to 35 weeks of parental EI leave under the same federal statutes that allow parental leave for natural parents. Unfortunately, adoptive parents do not currently qualify for the additional 15 weeks of maternity medical leave that natural parents receive.


The Adoption Council of Ontario is one of many voices in the adoption community lobbying for these two separate benefit packages to be combined into a single 50 week parental leave program available equally to all parents.

One piece of good news is that, as of January 4, 2012, parents in Ontario taking part in a foster-to-adopt program can now qualify for EI benefits immediately upon the placement of the child rather than being forced to wait until the adoption has been finalized.
